The Art of Defiance Part 3: Become Ungovernable

I recently wrote and sent a “strongly worded letter,” to say the least. I told a crooked court that if they do not do justice, they can go to hell…

…and I meant it. 

Today, I enjoyed a new piece by one of my favorite commentators, Jeffrey Tucker, in his weekly piece for The Epoch Times, “How to Restore Freedom.” One line stood out above all others:

“Become ungovernable by those who have so overreached.”

Jeffrey and I are of the same mind. And if there was one statement that sums up Part 1 and Part 2 of this series, “The Art of Defiance,” this would do nicely!

Now, I said in Part 1 of this series, “I’m going to share some details of two arrests and the kangaroo court trial I endured—both in violation of my First and Fourth Amendment rights. I’m going to explain why these were entirely corrupt, unconstitutional and a breach of Natural Law. (‘The worst form of injustice is pretended justice’” Plato asserted.)”

I’m doing that now in the form of a printed letter I sent last week, regarding a (absurdly false) conviction placed upon me by a corrupt Tucson magistrate as a means of political persecution.

As my friend Clay Clark recently told me, he, Eric Trump, Don Jr., Kash Patel, Peter Navarro, and others are constantly being sued, subpoenaed, and threatened with prison as attempts to silence them. “Their strategy is to bleed you dry defending yourself,” he said. In my experience his is often done through proxies—businesses, entities or individuals conducting the persecution on behalf of the government as a cover…aka fascism.

The world has watched as corrupt (often Soros-funded) prosecutors have abused our legal system in multiple attempts to interfere with the 2024 elections, and prevent Donald J. Trump from running for office. With newly released footage from the January 6 Washington D.C. protest, the public is gradually waking up to the fact that it was not an “insurrection,” but rather a setup and in fact an attack by government on their political opponents, while turning a blind eye to “mostly peaceful” riots by BLM, Antifa, and more recently Hamas supporters.

We all know this is politically motivated abuse of the Rule of Law, transforming it into Rule BY Law—no one knows this more than the abusers—and no person, party, or authority on earth is authorized by our form of government to rule by fiat. The Founders were clear on that, which is the principal reason why they recognized the right to bear arms for the defense of our freedom from just such abusive regimes. (God willing, we resolve this without having to resort to the Second Amendment.)

The Samuel Adams Patriot

I, personally, will never submit to the weaponization of the government against the People—and I have the scars to prove it. I have been arrested twice for exercising my First Amendment right to speak out against tyranny and corruption; I even had to sit through a kangaroo court trial for speaking out against the abusive treatment of our children by schools and school boards.

Samuel Adams was also threatened with arrest, imprisonment and worse, and his response was,

“Tell Governor Gage, it is the advice of Samuel Adams to him to no longer insult the feelings of an exasperated people!”

This is a free Republic where everyone in government answers to the People, and we do not have to tolerate corrupt, abusive, incompetent tiny tyrants any more than Samuel Adams did. So, I decided to follow Samuel Adams’ lead and defy unjust and corrupt abuse of power. This is, according to the American form of government, not just a right, it is a duty before God.

I had the opportunity this fall to visit the grave of Samuel Adams in Boston.

I wrote the senior Tucson City Judge, Antonio Riojas regarding the absurd political persecution and prosecutorial misconduct of magistrate Geraldine Hale in a letter dated October 16, 2023.

Hon. Antonio Riojas,

I write you regarding my recent trial before the Tucson City Court.

Pima County has illegally withheld nearly $10,000 from the sale of our Tucson home, through a judgement lien in violation of A.R.S. 33-1101, as well as in violation of the 4th and 5th Amendments, deliberately blocking my family from funds that would be needed for an appeal and preventing us from purchasing a new home for our family of seven.

We have spent $3,000 on a lawyer in an attempt to get back our funding, but they refuse to return it. Excerpt from a July 31, 2023 letter from our lawyer regarding the matter:

This email serves as the Walkers’ request for the immediate release of the $10,000 escrow holdback funds to the Seller (the Walkers). 

There is no question that the subject property was the Walkers’ homestead property per A.R.S. 33-1101.  Prior to the closing, Mr. and Mrs. Walker occupied the property as their primary residence for the immediate three years and they owned no other real property.

Further, inasmuch as the sales price was $350,000 and inasmuch as the sellers’ proceeds was less than $100,000, there is no contractual or legal reason for Catalina Title to continue to hold the $10,000 and the entire $10,000 should be immediately released to my clients. Failure to release the $10,000 to my clients will subject Catalina Title Agency to liability for breach of its fiduciary duty to my clients.  Burkons v. Ticor Title Ins. Co., 168 Ariz. 345, 813 P.2d 710 (1991).   

The County and the City of Tucson have subjected my family to ongoing political persecution since they falsely arrested me September 15, 2020 for speaking publicly at the Board of Supervisor’s meeting against their fraudulent listing of our business on their covid “wall of shame.” That arrest was dismissed.

More recently, my family was put through continued political persecution through an illegitimate trial continued by Magistrate Geraldine Hale. A March 9, 2021 article in Tucson.com titled, Tucson City Council Reappoints Judge Despite Commission’s Recommendation, reported of Hale:

“The City Magistrate Merit Selection Commission, a review board that both recommends candidates and reviews the performance of Tucson City Court judges, made the rare recommendation on Feb. 11 that the City Council vote against reappointing Hale to another term…The commission said it spoke to more than 35 prosecutors, public defenders, judges and defense attorneys from the city and county who spoke against Hale’s reappointment, citing what they said was her erratic temperament and lack of basic legal knowledge.

Further it was reported that, “When reviewing Hale’s performance, the magistrate commission found reports of the judge being abusive toward parties and counsels, having trouble understanding basic legal principles and failing to afford due process to defendants who come before her.”

Judge, you watched the entire video [readers: here’s a sped-up video without sound] documenting the incident at Mesquite Elementary and made these comments in Court, which can be applied to all three fathers:

“A couple things I noticed. One, [the] defendant never raised his voice. He never stood up, which I found very significant because—you’re right—his size could be very intimidating if he stood up and got in your face, but he didn’t. He sat down the whole time. The one thing I was looking for: what steps he did. I mean, what he did was disagree with you. That’s not disorderly conduct. That’s not rude; that’s not threatening. You guys [public school staff] don’t get to define how people disagree with you. School districts don’t have that right. The citizens have that right. I’m dismissing the order.”

The other two fathers were let off with plea deals and small fines, while I was sentenced to $10,000 in fines and 100 days in jail—for misdemeanor 3 trespassing, and I have no priors! I am the only one of the three who is a public personality with a platform, and this is clearly retribution for speaking out against their policies, as well as violation of the 8th Amendment viz cruel and unusual punishment.

Pima County and the City of Tucson have politically persecuted my family for three years, and I’m done. I will not have my family persecuted further and will not put them through devastating expense and drama of appeal. I have been discussing the matter with members of Congress, including the Judiciary Committee Special Subcommittee on the Weaponization of the Government, as well as with the Arizona Senate Majority leader. This matter is currently under investigation.

Our Founding Fathers understood that under normal circumstances, the Rule of Law is necessary, but they also understood that the law and the legal system would be used by tyrants as weapons against individual rights. “The most sacred of duties of a government,” Thomas Jefferson said “is to do equal and impartial justice to all its citizens”?

“A strict observance of the written laws is doubtless one of the high duties of a good citizen,” he wrote. “But it is not the highest. The laws of necessity, of self-preservation, of saving our country when in danger, are of higher obligation.”

John Locke wrote: “Any single man must judge for himself whether circumstances warrant obedience or resistance to the commands of the civil magistrate; we are all qualified, entitled, and morally obliged to evaluate the conduct of our rulers. This political judgment, moreover, is not simply or primarily a right, but like self-preservation, a duty to God. As such it is a judgment that men cannot part with according to the God of Nature. It is the first and foremost of our inalienable rights without which we can preserve no other.”

The Founders knew well that Cicero wrote, “If the temporary masters of the state are unjust—that is, if they act contrary to the law of nature—men possessing right reason are under no moral obligation to obey them.”

In light of the egregious behavior of Hale and the weaponized political machine that destroyed our business, unjustly arrested me twice, labeled me a “criminal” and the plaintiffs “the victims” even prior to trial (denying me presumption of innocence, grounds for mistrial), I invoke my Natural Rights.

I believe you to be a just and wise judge, which is why I am writing you this letter. If you can provide remedy, so be it. If not, then to hell with abusive, corrupt, and unjust tyranny. I will fight this all the way to the highest offices.

With all due respect, it is by duty before God to defy tyranny, as the Founders of our still-beautiful country did so many years ago.

I will not ascribe any legitimate authority to someone so abusive of our sacred Justice System. It is my duty as a free American citizen to tell such little tyrants to pound sand and stop abusing the power on loan from the People. In fact, Geraldine Hale, you have broken the social contract repeatedly and it is your duty to step down immediately.

Jeffrey Tucker concluded “How to Restore Freedom” thus:

How do we rebuild? Yes, politics can help. Good court decisions are always welcome. Brave politicians are needed. But none of this is going to accomplish the goal. The great rebuilding will come from within our own lives and communities, as inspired by hope, driven by courage, powered by affection and loyalty, and assured by moral determination. In other words, the answer to the question is all around us, right where we are. People often ask me for answers to the myriad problems in the world. I’m not the one to give them. You are. Care for your health, your family, your personal finances, your safety and mental well-being. Reach out to others. Be a good friend and neighbor. Assist in the heroic tasks by building a new freedom within your own reach. Become ungovernable by those who have so overreached. This is the path forward.
